The FIRPTA Tax Rate applicable may be 15% (versus the old 10% rate) on properties selling for US $1 Million or more.
The 10% rate may apply for properties selling for under $1 Million – only if they meet the IRS criteria to be still eligible for the 10% rate. Otherwise, the 15% FIRPTA rate may apply to those sales under $1 million!

For any potential exceptions to FIRPTA withholding tax applicable, these are not generally “automatically” applicable for the FIRPTA Exclusion.
You must file an Early Withholding Exemption Applications with the IRS in advance of a real estate closing in general.
The IRS will hold you liable if deems you are a responsible party for the FIRPTA withholding tax!
A Realtor, purchaser, or real estate attorney who has a foreign non-resident individual client faces this exposure. The same goes for a foreign entity or even a U.S. entity which is owned by a foreign person.
